Alimony Representation in Orange County California
Under California Law, the Family Law Courts are not required to grant spousal support automatically. An award of spousal support is based on the dozen criteria of Family Code § 4320. Which ones apply are case specific, including the following:
•Earning capacity of each spouse;
•Existence and enforceability of a premarital or postmarital agreement;
•Extent to which each has contributed to the education / training of the other;
•Health & age of each spouse;
•Length of the marriage;
•Level of education of each spouse;
•Sources of income available to each spouse;
•The standard of living enjoyed during the marriage.
If you and your spouse are unable to successfully resolve your case through Collaborative Divorce or Divorce Mediation, the amount of spousal support that is awarded and the duration for which it is awarded is subject to judicial discretion. Generally, in short term marriages (those lasting less than 10 years), the Courts tend to award alimony for a period of time that is equal to or less than the number of years that the parties were married. For marriages deemed “long-term,” over ten years, judges have the discretion to award spousal support for an extended time period, up to and including either the remarriage or death of the supported spouse.
Spousal support may be modified at any time if the party seeking a spousal support modification is able to successfully demonstrate a change in circumstances that would warrant adjusting the orders.
